Die Lizenzbedingungen zu OS X 10.5. (Leopard) habe ich jetzt nicht auf der Apple Seite gefunden, daher 10.6. als Beispiel:

3. Transfer. You may not rent, lease, lend, sell, redistribute or sublicense the Apple Software. Subject to the restrictions set forth below, you may, however, make a one-time permanent transfer of all of your license rights to the Apple Software (in its original form as provided by Apple) to another party, provided that: (a) the transfer must include all of the Apple Software, including all its component parts (excluding Apple Boot ROM code and firmware), original media, printed materials and this License; (b) you do not retain any copies of the Apple Software, full or partial, including copies stored on a computer or other storage device; and (c) the party receiving the Apple Software reads and agrees to accept the terms and conditions of this License.

Apple System Restore Copies: Restore CDs or DVDs that may accompany an Apple hardware bundle, or are otherwise provided by Apple in connection with an Apple hardware bundle, contain a copy of the Apple Software that is to be used for diagnostic and restorative purposes only. These CDs and DVDs may be resold or transferred only as part of the Apple hardware bundle.

Mein Fazit (als Nicht-Jurist) wie Apple das gerne hätte (ob das vor Gericht durchsetzbar wäre weiß ich nicht):

Die Snow Leo Retail Version darf innerhalb der Lizenzbestimmungen weitergegeben werden, wenn man das vollständige Software-Paket weitergibt.

Die mit einem Mac zusammen ausgelieferten Snow Leo CDs/DVDs gehörten zu diesem Mac und sind nur zusammen mit diesem weiterzugeben.

Ein bei Auslieferung vorinstalliertes El Capitan kann zusammen mit der Hardware auf der es installiert war weitergegeben werden. Ein nachträglich im Mac App Store gekauftes nicht.

Ich hoffe mal, dass der TE damit eine Entscheidung fällen kann, wie er weiter vorgehen möchte.
